Biosolids Land Application and Several Other Virginia State Water Control Board Regulatory Issues in Fall 2011

On September 22, 2011, the Virginia State Water Control Board (SWCB) gave final approval to several changes to the Commonwealth’s regulations for land application of biosolids, or treated sewage sludge (sections 9 VAC 25-20, 9 VAC 20-31, and 9 VAC 20-32 in the Virginia Administrative Code).  Detailed information on the changes is available from the and from the Virginia Department of Environmental Quality, online at http://www.deq.virginia.gov/Programs/Water/LandApplicationBeneficialReuse/SewageSludgeBiosolids.aspx (link functional as of 3/9/17)   Source: State panel approves overhaul of waste rules, Richmond Times-Dispatch, 9/23/11.

Meanwhile, following are several other regulatory actions that either are currently under consideration or have just been adopted by the SWCB.  Numbers in brackets refer to the relevant section(s) of the Virginia Administrative Code, which is available/searchable online at http://leg1.state.va.us/cgi-bin/legp504.exe?000+men+SRR.

Water Quality Standards [9 VAC 25‑260] – Nutrient Criteria for the Tidal James River.  Comment period ends 10/12/11.

Water Quality Standards [9 VAC 25‑260] – Designate a portion of Bull Run as Exceptional State Waters.  As of 9/28/11, the proposal was being reviewed by the Secretary of Natural Resources.

Water Reclamation and Reuse Regulation [9 VAC 25‑740] – Amendments to promote enhance program implementation.  As of 9/28/11, the amendments were under review by the Secretary of Natural Resources.

General Virginia Pollutant Discharge Elimination System (VPDES) Permit for Pesticide Discharges [9 VAC 25‑800].  A general permit for discharges from pesticides applied directly to surface waters to control pests, and/or applied to control pests that are present in or over, including near, surface waters.  The regulation becomes effective 10/31/11.

General Virginia Pollutant Discharge Elimination System (VPDES) Watershed Permit Regulation for Total Nitrogen and Total Phosphorus Discharges in the Chesapeake Bay Watershed [9 VAC 25-820].  SWCB adopted on 9/22/11.

General Virginia Pollutant Discharge Elimination System (VPDES) Permit Regulation for Vehicle Wash Facilities and Laundry Facilities [9 VAC 25-194].  SWCB approved for public comment on 9/22/11.
