Virginia Water-supply Planning, Chesapeake Bay Preservation Areas, Erosion/sediment Control, and Stormwater Management are Subjects of Two Regulation-amendment Proposals and Public-comment Periods in April-May 2014

The Commonwealth of Virginia has two public-comment periods until mid-May 2014 on several areas of water-resources regulation.  Information on the two proposed regulatory actions and respective public-comment periods follows.  Some of the information for this post was provided by the Virginia Water Monitoring Council (VWMC).  More information about the VWMC is available online at http://vwrrc.vt.edu/vwmc/default.asp.

Periodic Review of Local and Regional Water Supply Planning Regulation – Here is information from the Virginia Regulatory Town Hall notice: The purpose of this review is to determine whether this regulation should be repealed, amended, or retained in its current form. Public comment is sought on the review of any issue relating to this regulation, including whether the regulation (i) is necessary for the protection of public health, safety, and welfare or for the economical performance of important governmental functions; (ii) minimizes the economic impact on small businesses in a manner consistent with the stated objectives of applicable law; and (iii) is clearly written and easily understandable. The comment period runs April 21 through May 12, 2014. Comments may be submitted online to the Virginia Regulatory Town Hall at http://www.townhall.virginia.gov/L/Forums.cfm. Proposed Amendments to Regulations on Chesapeake by Preservation Area Management, Erosion and Sediment Control, and Stormwater Management – Here is information from the Virginia Regulatory Town Hall notice: The State Water Control Board (SWCB) is considering the amendment of regulations on erosion and sediment control, stormwater management, and Chesapeake Bay Preservation Area management. The regulations being considered for changes are as follows (citations in parentheses are sections of the Virginia Administrative Code, which is available online at http://leg1.state.va.us/cgi-bin/legp504.exe?000+men+SRR):Chesapeake Bay Preservation Area Designation and Management Regulations (9 VAC 25-830; Erosion and Sediment Control Regulations (9 VAC 25-840); Virginia Stormwater Management Program (VSMP) Regulation (9 VAC 25-870); and General Virginia Pollutant Discharge Elimination System (VPDES) Permit for Discharges of Stormwater from Construction Activities (9VAC25-880). The SWCB is considering adopting amendments to the named regulations on June 26-27, 2014.  The amendments are necessary to implement legislation passed by the 2014 Virginia General Assembly, except for the requirement for the development of procedures for a locality that operates a VSMP to transfer administration of the VSMP to the Department of Environmental Quality (regulatory amendments to implement that requirement will be announced in the future).
