Virginia Reviewing Policies on Clean-up from Leaking Heating Oil Tanks; Report Due to General Assembly by November 30, 2015

The state budget passed by 2015 Virginia General Assembly required the Virginia Department of Environmental Quality to conduct a review of current guidance and policy governing the cleanup of petroleum releases.  The DEQ was also required to form a stakeholder group to offer advice during the review process.   According to the Virginia Regulatory Townhall notice for the stakeholder group’s August 3, 2015, meeting, the review is expected to consider the following: “a) if DEQ’s present guidance is being applied uniformly across regional offices; b) the adequacy of DEQ’s guidance with respect to groundwater protection regulations and DEQ’s technical regulations regarding petroleum spill remediation; and c) the appropriate deductibles for homeowners.”
